CE Marking

What is CE Marking (CE Mark)?

CE Marking is the symbol of letters "CE" which are the abbreviation of French phrase "Conformité Européene" which literally means "European Conformity". The term initially used was "EC Mark" and it was officially replaced by "CE Marking" in the Directive 93/68/EEC in 1993. "CE Marking" is now used in all EU official documents. "CE Mark" is also in use, but it is NOT the official term.

  1. CE Marking on a product is a manufacturer's declaration that the product complies with the essential requirements of the relevant European health, safety and environmental protection legislation, in practice by many of the so-called Product Directives.*

*Product Directives contains the "essential requirements" and/or "performance levels" and "Harmonized Standards" to which the products must conform. Harmonized Standards are the technical specifications (European Standards or Harmonization Documents) which are established by several European standards agencies (CEN, CENELEC, etc).

CEN stands for European Committee for Standardization.
CENELEC stands for European Committee for Electrotechnical Standardization.

  1. CE Marking on a product indicates to governmental officials that the product may be legally placed on the market in their country.
  2. CE Marking on a product ensures the free movement of the product within the EFTA & European Union (EU) single market (total 28 countries), and
  3. CE Marking on a product permits the withdrawal of the non-conforming products by customs and enforcement/vigilance authorities.

Along with more directives' becoming effective, more and more products are required to bear the CE Marking for gaining access to the EFTA & European Union market. However, many non-EU exporters are still unaware of or unsure about this fact and its impact on their business.

Why is CE Marking called-
the "Passport to Europe" for non-EU products?


The European Union's 'New Approach directives' are mandatory on all member countries to enact through national legislation.

This legislation requires manufacturers to display CE Marking on their product, packaging and accompanying literature. Where a new approach directive is in force, it is (with few exceptions) an offence to place a product on the market without CE Marking. The manufacturer is legally responsible for ensuring that the product confirms to the requirements of the directive and for applying CE Marking.

CE Marking is one important measure that the EU has adopted to establish the single market and foster economic development for the member states. The objective of the directives is to simplify the movement of goods into and within the EU. This may eventually lead to the free movement of goods throughout Europe as more and more european countries are expected to join the EU. The European Commission thus refers to the CE Marking as a "Passport" which allows products to be freely circulated within the EU single market.


Often, consumers will consider CE Marking on a product as an indication of conformance to laid down minimum standards, and therefore a minimum level of quality which other products may lack. CE Marking is thus for many consumers a "Symbol of Quality." Being a manufacturer exporting to EU, if you have not got your products fixed with CE Marking, it is now time to invest in it. A CE Marking on your product will be more valuable than millions of dollars spent on TV advertising. Nowadays, it is not unusual to see some high-quality, even known brand, products have to appear in Second-hand Stores (which sells used products) or on street-vendor's Stands. Why? lack CE Marking!

How does CE Marking
affect the export to Europe?


If the new product directives apply to your products and you want to continue to export to the European market (or introduce new products), then CE Marking will be crucial to your success.

It is NOT unusual nowadays that non-EU manufacturers and exporters have had their product(s) seized by customs officials in the European Union at the worst or returned to them because they do not have the CE marking affixed to the product(s).

The CE Marking can be, at the same time, of both benefits and disadvantages.

Benefits:

  • With this "passport" your products can easily gain access to the entire European Union (EU) plus European Free Trade Association (EFTA) market.
  • There will be only one set of laws and regulations for the entire marketplace which guide the designing, manufacturing and labeling of products. The multiple and conflicting national restrictions on regulated products will be eliminated. Thus the CE Marking on your product will make your trade with EU countries cheaper and easier.
  • Your product will be made safer for consumers and thus the damage claims and liability premiums will be reduced.

Disadvantages:

  • New product directives may exceed the current national laws and regulations. It may cost a manufacturer extra to modify the currently existed design and/or production line in order to continue exporting to or gain access to this huge European market.
  • Extra costs in obtaining the product Certificate of Registration for CE Marking and any, if applicable, required testing certification.

How many countries
are currently requiring products to bear CE Marking?


Total 28 countries.

Before May 1, 2004 these were the 15 European Union (EU) member countries: Austria, Belgium, Denmark, Finland, France, Germany, Greece, Ireland, Italy, Luxemburg, the Netherlands, Portugal, Spain, Sweden and United Kingdom (Great Britain) plus the European Free Trade Association - EFTA's 3 member states: Iceland, Liechtenstein and Norway.

Since May 1 2004, the following 10 new member states joined the EU, which also adopted the CE-Marking requirements:

Estonia, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Hungary, Slovenia, Malta, and Cyprus.

Does my product need CE Marking?

CE Marking is most probably required if you export to the 25 European Union (EU) and 3 European Free Trade Association (EFTA) member states the following 22 groups of products -

  1. Appliances Burning Gaseous Fuels (AppliGas)
    The "appliances burning gaseous fuels" used for cooking, heating, hot water production, refrigeration, lighting or washing and having, where applicable, a normal water temperature not exceeding 105 gC. Forced draught burners and heating bodies to be equipped with such burners will also be considered as appliances.
    The "gaseous fuel" means any fuel which is in a gaseous state at a temperature of 15 gC under a pressure of 1 bar. more >>
  2. Cableway Installations to Carry Persons
    The "cableway installations designed to carry persons" shall mean installations made up of several components, designed, manufactured, assembled and put into service with the object of carrying persons.
    These on-site installations are used for the carriage of persons in vehicles or by towing devices, whereby the suspension and/or traction is provided by cables positioned along the line of travel. . more >>
  1. Low Voltage Electrical Equipment

How to achieve CE mark approval, CE testing and meet all CE mark requirements, for my product?

There are a series of steps outlined below for CE mark approval. Depending upon your product and the nature of the risks it presents:

  1. Determine if any directives apply to your product. If more than one applies you will have to comply with all of them.
  2. Determine the extent to which your product complies with the essential requirements for design and manufacturing in the applicable directive(s).

Choose the conformity assessment procedure from the options (modules) called out by the directive for your product. There are several modules available for the Conformity Assessment Procedures as listed below:

Module A: internal production control
Module Aa: intervention of a Notified Body
Module B: EC type-examination
Module C: conformity to type
Module D: production quality assurance
Module E: product quality assurance
Module F: product verification
Module G: unit verification
Module H: full quality assurance

The directives often use a series of questions about the nature of your product to classify the level of risk and refer to a chart called "Conformity Assessment Procedures". The chart includes all of the acceptable options available to a manufacturer to certify their product and affix the CE Marking.

Minimal Risk

Options for products with minimal risk include self certification where the manufacturer prepares a Declaration of Conformity and affixes the CE Marking to their own product.

Greater Risks

Many directives require products/systems with greater risks to be independently certified; this must be done by a "Notified Body". This is an organization that has been nominated by a Member Government and has been notified by the European Commission. Notified bodies serve as independent test labs and perform the steps called out by directives. They must have the necessary qualifications to meet the testing requirements set forth in the directives. Notified bodies may be a private sector organization or a government agency. Manufacturers may choose a notified body in any member state of the European Union. Lists of notified bodies are published by the European Commission in the Official Journal of the European Communities.

A Notified Body is usually able to offer some of the services required:

  • product testing
  • type examination certificate issue
  • Technical File and design dossier evaluation
  • surveillance of product and quality system
  • identification of standards

If your products need to be certified by a Notified Body, then you will need to do as the follows:

  1. Select the applicable product standards and test methods for your product and select a Notified Body.

  2. Establish an Authorized Representative in the European Union for your product.

    Some directives require that a manufacturer designate in the European Union an authorized representative to produce Technical Documentation (or sometimes called Technical File) in a timely fashion when called upon to do so. The CE Marking itself is not meant to provide details about the product to Surveillance Authorities.

Technical Documentation (Technical File): The directives require for many products that a Technical Documentation (Technical File) be prepared by the manufacturer. The Technical Documentation (Technical File) holds information that verifies that the testing was conducted properly and that the product complies with applicable standards.

  1. Prepare a Declaration of Conformity.
    The Declaration of Conformity must contain information adequate for tracing the product back to the manufacturer or the authorized representative in the European Union. It may include a list the directives and standards that your product conforms to, product identification, the manufacturer's name, address and signature.
  2. Register your product in EU
    Many products, for instance, Class I Medical Devices, are required to be registered in the EU and, if proved, get a Certificate of Registration. Without this Certificate of Registration, the products are NOT allowed to be affixed with the CE Marking and be placed on the market.
  3. Affix the CE Marking to your product.
    There are specific rules to adhere to for the CE Marking. These rules address the size and location of the Marking; affixing the CE Marking to products, packaging and material or documents shipped with the product; and specific limitations on when and who is permitted to affix the CE Marking.

Who's going to enforce the requirement for CE Marking?

Each member state of the European Union (EU) is bound by the General Product Safety Directive to adopt laws, regulations and administrative provisions to ensure that products placed on the market are safe. Each country has its own way of handling enforcement.

Many have added staffs specifically to conduct spot checks against implemented directives and respond to complaints. Countries have also set in place a combination of Return-to-Origin procedures, financial penalties, etc.
EU legislations make EU importers liable for the products they import, including the machinery they provide to their employees for work. Many non-EU exporters are finding that no matter how interested a prospective EU importer may be in the product, the importer will NOT risk importing non-conforming products (i.e. the products without CE Marking) which, in case of accident, may generate legal action against them.

A Standard Business Plan Outline

As I write here about business plan outlines, please remember that your plan should be only as big as what you need to run your business. While everybody should have planning to help run a business, not everyone needs to develop a complete formal business plan suitable for submitting to a potential investor, or bank, or venture contest. So don’t include outline points just because they are on a big list somewhere, or on this list, unless you’re developing a standard business plan that you’ll be showing to somebody else who expects a standard business plan.

And in that case, if you do need a standard plan, then there are predictable contents of a standard business plan. For example, a business plan normally starts with an Executive Summary, which should be concise and interesting. People almost always expect to see sections covering the Company, the Market, the Product, the Management Team, Strategy, Implementation and Financial Analysis.

If you have the main components, the order doesn’t matter that much, but here’s the order I suggest.

  1. Executive Summary: Write this last. It’s just a page or two of highlights.
  2. Company Description: Legal establishment, history, start-up plans, etc.
  3. Product or Service: Describe what you’re selling. Focus on customer benefits.
  4. Market Analysis: You need to know your market, customer needs, where they are, how to reach them, etc.
  5. Strategy and Implementation: Be specific. Include management responsibilities with dates and budgets. Make sure you can track results.
  6. Web Plan Summary: For e-commerce, include discussion of website, development costs, operations, sales and marketing strategies.
  7. Management Team: Describe the organization and the key management team members.
  8. Financial Analysis: Make sure to include at the very least your projected Profit and Loss and Cash Flow tables.

I don’t recommend developing the plan in the same order you present it as a finished document. For example, although the Executive Summary obviously comes as the first section of a business plan, I recommend writing it after everything else is done. It will appear first, but you write it last.

Standard Tables and Charts

There are also some business tables and charts that are normally expected in a standard business plan.

Cash flow is the single most important numerical analysis in a plan, and should never be missing. Most plans will also have Sales Forecast and Profit and Loss statements. I believe they should also have separate Personnel listings, projected Balance sheet, projected Business Ratios, and Market Analysis tables.

I also believe that every plan should include bar charts and pie charts to illustrate the numbers.

‘Muslim Feminist’: Oxymoron or Islam in Action?

AYAT-AYAT Cinta (Verses of Love) is the blockbuster movie about polygamy that has been filling movie the- aters. People who have seen it—including our weepy President SBY—rave about it. But Musdah Mulia, the outspoken Muslim scholar and activist, sure doesn’t agree! In fact, it is no exaggeration to say that she is outraged.

“It’s a garbage film which is only trying to sell religious symbols. As a Muslim I am ashamed, and as a Muslimah (Muslim woman) who wears a jilbab (headscarf), I feel insulted!”

Musdah never minces her words, but she has a point. The film, a huge hit in Indonesia, portrays four women (which is a start), but all are seen through the lenses of conservative, patriarchal Islam. One is a cowardly liar who almost lets the man she loves be sentenced to death after she falsely accuses him of rape. Another dies of a broken heart because she can’t resolve her inner contradictions, while a third, married by arrangement, pushes her husband into a polygamous marriage.

The message here is that women in Islam are passive, sub- ordinate and weak. This fits the clichĂ©, but it’s a very long way from the full story of women in Islam—and especially not Indonesian women.

The common perception is that Islam is conservative, and therefore incompatible with human rights, including women’s rights. Feminists, on the other hand, are usually considered left-wing conduits of Western, liberal values. So what to make of the term ‘Muslim feminist”? Is it not an oxymoron?

Not necessarily, it all depends on how you look at them. For starters, both feminism and Islam have universalizing values; Islam is the fastest-growing faith, feminism the fastest-growing ideology. Both Islam and feminism are besieged by detractors from outside and within: conservatives are always trying to run down feminism, while Islam is constantly linked to terrorism, as if all Muslims endorse the ideologies of extremists (which they most certainly do not).

Far from being an oxymoron, the “Muslim feminist” is, in fact, the true reformer. Secular feminists base their struggles on ideological grounds, but Muslim feminists look to both theology and ideology. They seek to highlight teachings of equality deeply rooted in the Qur’an, and question patriarchal interpretations of Islamic teaching. After all, as Musdah points out, “Islam liberated women 1,400 years ago, way ahead of the West.” According to her, much of the way Muslim women are being treated now is, in fact, un-Islamic: she blames gender inequity on Muslims, not on Islam.

In Indonesia, Musdah is just one of many Muslim feminists, but she stands out. A graduate of the State Islamic University (UIN), she was the first woman to receive a PhD in Islamic political thought and now teaches at her alma mater. She’s published books on contemporary Islam, Islamic public policy, gender equality and polygamy. She was the leader of the Gender Mainstreaming Team from the Department of Religious Affairs, and is a member of the board of directors of the International Center for Islam and Pluralism (ICIP), as well as being active in other research bodies and social organizations, including the Institute for Religion and Gender Studies

(LKAJ, Lembaga Kajian Agama dan Jender), the interfaith organization ICRP (Indonesia Conference on Religion and Peace) and the women’s wing of NU, the largest Muslim organization in Indonesia.

Whew! When did Musdah ever get time to watch Ayat-ayat Cinta?

And there’s more! On March 6, 2006, she was given the International Women of Courage Award, created by US Secretary of State Condoleezza Rice to recognize women around the globe who have shown exceptional courage and leadership in promoting women’s rights and advancement. For her devotion to both Islam and women’s rights, she has been condemned by conservative Muslim groups and radical Islamic groups have threatened her with death. But she told me she was ready to pasang badan, Indonesian slang which literally means to put your body up to receive whatever blows are aimed at you.

Musdah deplores the tendency that exists now within Is- lam for the teaching of hatred, which she says happens be- cause hardliners base their teachings more on fiqh (Islamic law, created by fallible humans) instead of the word of God in the Qur’an. But I think she hates the spread of hatred from any source. At the award-giving ceremony in the State Department, President Bush asked her what the US could do. Musdah’s reply was unambiguous: “Stop using violence as a solution, especially towards Islamic countries. Violence never solves anything.”

Pity he wasn’t really listening.

Not all Muslim feminists in Indonesia are as outspoken and forthright as Musdah, but in their own way they are all do- ing important work in many different areas: opposing violence against women, as well as violence in the name of religion, building women’s leadership in politics and as ulama (religious leaders) and working to reform our attitudes towards education, health, anti-trafficking, women’s empowerment and even sexuality. They engage in advocacy, run gender-sensitivity training programs and women’s crises centers (like Rifka Annisa in Yogyakarta), and support social programs like micro-credit schemes and income-generating projects, among many other activities.

One of the striking characteristics of Muslim feminists in Indonesia is that they constitute one of the most effective grass roots movements in the Islamic world. Chatting with Musdah, I said to her, “Wow, it’s just like Gerwani (the banned Indonesian Communist Party women’s wing): it’s a socio political movement!”“Yes,” she responded, “that’s true.” But perhaps not quite: while some Muslim feminists are affiliated to larger Muslim organizations, they all retain a large degree of autonomy. Their first loyalty is always to improving the position of their fellow Muslim women.

So how about a remake of Ayat-ayat Cinta so the women aren’t just a bunch of pathetic wimps? I reckon if they got Musdah Mulia to do a complete script rewrite Indonesia might just win its first Oscar!

7 Tips on How to Handle Phone Interviews


Phone interviews are becoming more and more common in the job search process. They save the company and the candidate a lot of time. If you are in the job market, it is important to prepare yourself for a phone interview.

1. Schedule it for a quiet time. If you have the opportunity to schedule the time of the phone interview, be sure to schedule it when you know you will be able to give them your full attention.
